Yes it has a very slight uphill tilt forward.
You are holding your new support bracket about 2" too far forward. I would first locate the new battery tray and it's support legs before planting the regulator support

An alternative for a correct stock M38 battery tray would be a CJ3A battery tray that is shortened so the forward battery box will fit correctly under the hood. Also a Brazilian member had a friend fabricate a new one for him that turned out quite well.
